Terms of Service

Effective date: October 6, 2026

1. Scope and provider

These Terms apply to all contracts for training programs, plans and coaching offered on this website by PACE ORGANIZATION LLC, 5830 E 2nd St, Ste 7000, Casper, WY 82609, USA (“we”, “us”). They apply to you as a customer (“you”). Terms of a customer that differ from these do not apply unless we agree to them in writing.

2. Our services

We offer online training programming for functional fitness. The current offer is described on our Programs and Coaching pages, in particular:

We provide training plans and guidance. We do not owe any particular training result, as results depend on your starting level, effort, recovery and other individual factors.

3. Conclusion of contract

The descriptions on this website are not binding offers but an invitation to order. A contract is concluded when you complete the booking process on FITR or in our checkout and we confirm your order, or, for 1:1 coaching, when we confirm the coaching after our initial conversation. A coaching request is non-binding.

4. Free trial and automatic renewal

The Pace 90 and Compete start with a free 7-day trial. If you do not cancel before the trial ends, your membership automatically continues as a paid monthly subscription at the price shown when you signed up (currently €35 or €45 per month), billed monthly in advance until you cancel. Each customer can use the free trial once.

5. Prices and payment

The prices shown at the time of your order apply. For consumers in the EU, prices include the VAT applicable in your country of residence. Payment is processed by Stripe; memberships and cycles are billed through FITR. Payment is due when you order or, for subscriptions, at the start of each billing period. If a payment fails, we may suspend access until the outstanding amount has been paid.

6. Term and cancellation

Memberships and 1:1 coaching have no minimum term. They renew monthly and can be cancelled at any time, effective at the end of the current billing month. Memberships can be cancelled directly in the FITR app; coaching can be cancelled by email to thepaceprogramming@gmail.com. The Pace 60, one-off cycles and online personal training sessions are one-time purchases and do not renew. The right of both parties to terminate for good cause remains unaffected.

7. The Pace 60

After purchase you complete our athlete questionnaire. We create your plan within 3–5 working days of receiving both your completed questionnaire and your payment, and send it to you as a PDF by email. The plan is based on the information you provide, so please make sure it is complete and accurate.

8. Online personal training sessions

Sessions take place by video call at the agreed time. If you need to reschedule, please let us know at least [24] hours in advance; sessions cancelled later or missed without notice may be charged in full.

9. Right of withdrawal

Consumers in the EU, EEA and UK have a statutory right of withdrawal. Details, including when it expires early, are set out in our Right of Withdrawal information.

10. Health and safety

Training involves physical strain and a risk of injury. You confirm that you are in good health and fit to train, or that you have consulted a doctor before starting. Scale movements and loads to your ability, use suitable and safe equipment and stop immediately if you feel pain or discomfort. Tell us about relevant injuries or limitations so we can take them into account. Our programs do not replace medical advice, diagnosis or physiotherapy.

11. Your account and use of content

Our programs, plans, videos and texts are protected by copyright. Your purchase gives you a personal, non-transferable right to use them for your own training. You may not share your login, pass on, resell or publish our programs or plans, or use them to coach other people, without our written permission. If you breach this, we may suspend your access.

12. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and wherever liability is mandatory under applicable law. For slight negligence we are only liable for breach of essential contractual obligations, and limited to the foreseeable damage typical for this type of contract. Otherwise our liability is excluded to the extent permitted by law. Nothing in these Terms limits rights you have as a consumer under mandatory law.

13. Third-party platforms

Memberships, cycles and coaching are delivered through the FITR app (Fitr Holdings Limited, UK). FITR’s terms of use also apply to your use of the app. We are not responsible for outages or changes of third-party platforms, but will do our best to give you access to your training by other means if FITR is unavailable for a longer period.

14. Changes to these Terms and prices

We may change these Terms or the price of ongoing memberships for the future. We will inform you at least 30 days before a change takes effect. If you do not agree, you can cancel before the change takes effect; otherwise the new terms apply from that date. We will point this out to you in our notice.

15. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA. If you are a consumer with your habitual residence in the EU, EEA or UK, this choice of law does not deprive you of the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts of that country. We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.

16. Final provisions

If any provision of these Terms is invalid, the remaining provisions remain in effect. The contract language is English. Questions? Email us at thepaceprogramming@gmail.com.
